Multiple hemp companies in New Jersey are engaged in ongoing discussions with the state regarding a law that bans the sale of intoxicating hemp products. After a federal judge upheld most of the law, parties are now filing status reports every 60 days to update the judge on any potential developments in resolving the legal challenge. The law, which went into effect in October, has caused confusion among business owners and state officials. It requires hemp businesses to obtain licenses through the state Cannabis Regulatory Commission to sell, manufacture, and distribute hemp. While the law aims to regulate intoxicating hemp products to prevent minors from accessing high-THC products, it has been challenged by hemp businesses as unconstitutionally vague. Although a judge agreed that parts of the law infringe on interstate commerce, they also acknowledged the state’s power to regulate hemp. Enforcement of certain provisions of the law has been put on hold, but restrictions on sales to minors and non-natural hemp products remain in effect with penalties for violations.
