Texas Hospital Violated Law by Discharging Woman with Complicated Pregnancy, Investigation Reveals

A federal investigation found that a Texas hospital violated the law by discharging Kyleigh Thurman, a 36-year-old woman suffering from a life-threatening ectopic pregnancy, without proper medical treatment. Despite displaying symptoms indicating danger, such as decreased hormone levels and an obstruction in her fallopian tube, Thurman was sent home after receiving only a pamphlet on miscarriage. Days later, her condition worsened, leading to emergency surgery and the loss of part of her reproductive system.

The findings provided a small victory for Thurman, who hoped the government’s conclusions would establish clearer guidelines for treating ectopic pregnancies—especially critical in Texas, known for its stringent abortion laws. The new policy from the Trump administration, announced recently, has raised concerns about the future of federal protections for women needing emergency abortions in medical emergencies, particularly following widespread abortion restrictions enacted post the Supreme Court’s 2022 ruling.

The Biden administration had aimed to clarify that hospitals must provide emergency abortions under federal law, specifically the Emergency Medical Treatment and Labor Act (EMTALA), which mandates treatment in life-threatening medical situations. However, recent statements from the Centers for Medicare and Medicaid Services (CMS) indicated that the earlier guidance would be revoked, thereby casting doubt on future enforcement practices.

Legal experts warn that such changes can lead to a chilling effect among medical personnel, potentially preventing necessary interventions. Despite state clarifications allowing treatment for ectopic pregnancies, many complications can arise throughout pregnancy, leaving patients like Thurman concerned about the adequacy of care in emergency rooms across Texas.
