Implementing Trump’s transgender order in NJ athletics

President Trump signed an executive order titled ‘Keeping Men Out of Women’s Sports’ which immediately bans transgender athletes from participating in girls and women’s sports. The order could potentially impact New Jersey athletes, although the full extent is still unclear. The NCAA has already amended its transgender policy in response to the executive order, limiting competition in women’s sports to athletes assigned female at birth.

New Jersey Attorney General Matt Platkin has not yet commented on the order, but the state’s Law Against Discrimination currently protects transgender athletes. However, under the supremacy clause of the U.S. Constitution, federal law and a presidential order take precedence over state law. The potential impact on New Jersey athletes remains to be seen, and the state could challenge the order on the grounds of discrimination and a violation of civil rights for a protected class.

The order has sparked controversy, especially in light of the recent case of Ramapo College swimmer Meghan Cortez-Field breaking a women’s school team record after competing with the men’s team for three years. While the legal implications of the executive order are still unfolding, it has already raised concerns about fairness and inclusion in sports.
